Public Ministry requests RD$10 million coercion for Ángel Martínez for digital defamation

SANTO DOMINGO.- The Public Ministry requested, through the Department of Intellectual Property Investigations and Investigations of Crimes and High Technology Crimes of the Prosecutor’s Office of the National District, the imposition of coercive measures against Ángel Ramón de Jesús Martínez Jiménez for his connection to cybercrimes to the detriment of Milagros Marina De Camps Germán. The request was filed before the Coordination of the Instruction Courts of the National District, by virtue of the violation of articles 21 and 22 of Law No. 53-07 on High Technology Crimes and Offenses.

According to the instance, on various dates the defendant incurred defamation and insult against the victim through publications made through their social networks. The lawyer by profession alleges that the publications, without any basis or evidence, directly affected her work, personal and professional life. The Public Ministry requested the imposition of an economic guarantee amounting to ten million Dominican pesos (RD$10,000,000), periodic presentation, and a ban on leaving the country, in accordance with the provisions of numerals 1, 2, and 4 of article 226 of the Criminal Procedure Code. The request was submitted by Kelvyn Colón, technical director of the National District Attorney’s Office; Marineldy Peña, prosecutor and coordinator of the Department of Intellectual Property Investigations and High Technology Crimes and Investigations, and the auditor Rafael Reyes. The Coordination of Instruction Courts empowered the Seventh Instruction Court to hear the measure. The hearing was initially scheduled for 9:00 a.m. this Thursday, and was later postponed until 2:00 p.m., at the request of the defendant’s lawyers, who claimed not to have prepared the defense budgets of the defendant who faces other similar processes in other demarcations of the country.
