Santo Domingo.– The Executive Branch submitted this Friday to the Senate of the Republic a bill to amend Law 74-25 of the Penal Code, which contemplates changes to 18 of its articles.
Among the provisions included in the proposal is Article 354, one of the four that were challenged by the Dominican Medical College (CMD) through an appeal of unconstitutionality filed at the end of June before the Constitutional Court.
Article 354 establishes sanctions for physicians who issue false certifications regarding a person’s state of health or the cause of their death. Current legislation provides for penalties of one to two years of minor imprisonment and fines of three to six minimum wages of the public sector.

The same provision also contemplates the same sanctions for any person who makes fraudulent use of a medical certificate issued falsely.
The initiative is part of the package of 18 amendments promoted by the Executive Branch with the purpose of introducing adjustments to the new Penal Code before it enters into force.
