Santo Domingo.- Accepting the request of the Public Ministry, a judge imposed three months of preventive detention, as a coercive measure, against Wilker Peña Mota, who attacked his one-year-and-eleven-month-old daughter with a nail, in an incident that occurred last week in the municipality of Villa Riva, in Duarte province.
The coercion measure to be enforced in the Vista al Valle Correction and Rehabilitation Center, of San Francisco de Macorís, imposed the coercion measure against the accused, arrested in flagrante delicto and prosecuted for engaging in physical and psychological abuse against the girl and aggravated domestic violence.
During the investigations, it has been established that the event occurred after the now-prosecuted arrived at his home in the early hours of the aforementioned day. Upon arriving at his house, Peña Mota went to bed and then began to make gestures, stating that he was upset. It details that the now-prosecuted then got up violently, and, faced with the situation, his partner called for help, with a neighbor and the accused’s grandmother coming to the scene, whom he also injured with the nail.
The victims were taken to a local hospital, where doctors determined that the infant had multiple wounds in the occipital region, anterior and posterior thorax, abdomen, right and left extremities, and the woman was injured in the right shoulder.
The Public Ministry has attributed to the case the violation of article 396, letters A and B, of Law 136-03, which creates the Code for the Protection and Fundamental Rights of Children and Adolescents, as well as articles 307, 309-2, 309-3, letter E, of the Dominican Penal Code, modified by Law 24-97 on Gender and Domestic Violence.
