Santo Domingo.- <\/strong>The lawyer Jean Cristofer P\u00e9rez Lebr\u00f3n filed a complaint with civil action for one hundred million pesos (RD$100,000,000.00), on behalf of Ms. Kiara Lirisset Lantigua Ventura and Luissana Rolisset Grull\u00f3n Ventura, following the death of Lirisset Ventura Brito inside the Jet Set nightclub.<\/p>\n\n\nThe legal action, filed before the Fiscal Procurator’s Office of the National District, establishes criminal and civil liabilities against the owners of the establishment (Antonio Espaillat L\u00f3pez and Ana Grecia L\u00f3pez), as well as their company Inversiones E y L, S.R.L. Also included in the complaint are the City Council of the National District (ADN) and the Dominican State<\/strong>.\n\nAccording to the jurist, the facts constitute a presumed involuntary manslaughter due to negligence, as defined in article 319 of the Penal Code. He maintains that both the State and the mayor’s office failed to fulfill their duty to supervise and guarantee minimum safety conditions in places of high attendance, which, in his opinion, led to the fatal outcome.\n\n\n

\u201cThe State and the Mayor’s Office did not fulfill their constitutional obligation to protect the lives of citizens. Their omission allowed an establishment to operate without adequate safety conditions,\u201d<\/strong> P\u00e9rez stated.<\/p>\n\n\n\n

The complaint also points out violations of Article 8 of the Constitution, regarding the guarantee of the right to life and personal safety, as well as Law 176-07, which obliges local governments to exercise control over public and private spaces intended for mass events.<\/p>\n\n\n\n

In support of their claims, the lawyer also cites articles 1382, 1383, and 1384 of the Civil Code, which establish liability for damages caused by things under the custody or supervision of a person or institution.<\/p>\n\n\n\n

\u201cThe death of a person in a recreational space cannot go unpunished when it comes to a series of negligences. Here there are shared responsibilities that must be assumed before the justice system\u201d<\/strong>, P\u00e9rez emphasized.<\/p>\n\n\n\n
