The instance was presented by prosecutors Adolfo Augusto P\u00e9rez F\u00e9liz<\/strong>, head of the jurisdiction, and Francis Amaury Bid\u00f3 Matos<\/strong>, who requested the opening to trial<\/strong> considering that there is sufficient evidence<\/strong> that compromises the criminal responsibility of the accused.<\/p>\n\n\n\n

During a police intervention, a firearm of the brand Glock, model 19 GHT121<\/strong>, with a magazine and 15 cartridges, without legal documentation, was seized from him.\n\n\n

The weapon, according to the official record, belongs to Branly Fernando Lugo Rodr\u00edguez<\/strong>, who, according to statements by the accused himself, is his uncle.<\/p>\n\n\nThe arrest occurred after a discussion and struggle<\/strong> between Franco and Jos\u00e9 Yasel Cohen S\u00e1nchez<\/strong>, in the presence of a woman with whom the accused was sharing. The altercation was intervened by National Police officers, including second lieutenant Jos\u00e9 Rafael Cohen Beras<\/strong> (father of Cohen S\u00e1nchez), first lieutenant Kelvin Ra\u00fal Tejeda Ram\u00edrez<\/strong> and sergeant Lagarez Quezada<\/strong>.\n\nA medical evaluation determined that none of those involved presented recent injuries. Subsequently, both signed a notarial waiver<\/strong> on November 11. However, the Public Prosecutor’s Office decided to maintain the accusation for violation of article 67 of Law 631-16 on Weapons, Munitions and Related Materials<\/strong>, as the perpetrator<\/strong> of the act.\n\n\n

In parallel, Franco Aybar faces a judicial process in Puerto Plata<\/strong>, where he is being tried for child sexual abuse<\/strong>, along with a woman accused of sexual exploitation of her minor daughter<\/strong>.<\/p>\n\n\nThe Public Prosecutor’s Office requested the court to set a preliminary hearing to consider the request to open the trial and maintain the current coercive measure, consisting of periodic reporting<\/strong>, as the conditions that motivated its imposition have not changed.","protected":false},"excerpt":{"rendered":"
