In addition, it ordered that the case be referred to the Presidency of the Criminal Chamber of the Court of Appeal<\/strong> to appoint a new chamber<\/strong>, with the exception of the Third Chamber, to hear the matter.\n\n\n

You may be interested in<\/strong>: Former President of the Supreme Court of Justice<\/a><\/p>\n\n\nThe ruling, issued on July 31, 2025<\/strong>, grants \u201cmerit\u201d to the cassation appeals filed by several individuals and entities, including Juana In\u00e9s G\u00f3mez Williams, Lisetel Gonz\u00e1lez S\u00e1nchez, Manuel Joaqu\u00edn Aybar Ferrando, Leoncio Alm\u00e1nzar Obj\u00edo, Proyecciones Inmobiliarias Gowi, S.R.L.,<\/strong> and seven other parties.\n\nThe Supreme Court considered that the Court of Appeals violated due process<\/strong> by deciding on the appeals without holding a public hearing<\/strong>, a mandatory requirement according to the Criminal Procedure Code<\/strong>. Furthermore, it pointed out that the decision made in chambers<\/strong> violates the effective judicial protection and the right to defense<\/strong> of the accused, since article 420 of the Code requires setting a hearing once the appeal has been admitted.\n\n\n

Although the petitioners requested that the First Chamber of the Court of Appeals<\/strong> also be excluded, the Supreme Court rejected this request, clarifying that the judges of that chamber who did not previously hear the case can rule on the appeals<\/strong>.<\/p>\n\n\nIt should be noted that the Fourth Collegiate Court of the National District<\/strong> had declared the extinction of the criminal action in favor of:\n\n\n
