According to Senator Genao, the main objective is to separate contentious-administrative and contentious-tax matters from the Third Chamber, which currently deals with a dispersion of issues (labor, real estate, and contentious) that undermines its capacity to generate advanced jurisprudential development.\n\n\n

Administrative jurisdiction is vital to maintain a control of legality over the organs of the State, translating directly into respect for the right to good administration that must assist all citizens, in accordance with the constitutional basis of article 139.\n\nThe current problem lies in the fact that the Third Chamber faces the difficult task of hearing cassation appeals in matters whose doctrinal dogmatics are very specific and diverse. This plurality of jurisdictional requirements, especially in the contentious-administrative and tax fields, mitigates the possibility of providing prompt responses, compromising the fundamental right of litigants to judicial protection without delay.\n\n\n
