Companies that do not pay double salary, Christmas bonus or 13th salary, no later than this Saturday, December 20, will incur a violation of the Labor Code.<\/p>\n
The Ministry of Labor reminded that the Christmas bonus is due to all workers who have provided service in the company, even if they have not worked the full year and even if the employment contract has ended before.<\/p>\n
The Christmas salary consists of the twelfth part of the ordinary salary earned by the worker in the calendar year, however, in the event that the worker has not provided services for the entire year, they will be entitled to it in proportion to the time worked during the year.<\/p>\n
This payment will be calculated by dividing the total amount of ordinary wages earned by the worker during the calendar year by twelve, excluding without exception any remuneration for overtime and the salary corresponding to the participation in the company’s profits, nor computed for notice and severance pay, in accordance with articles 219 to 222 of the Labor Code.<\/p>\n
In that sense, articles 222 of the Labor Code 3 and 48 of Regulation No. 139-98 4, in addition to the annual exemption established in paragraph o) of article 299 of the Tax Code, provide for the exemption from Income Tax on Christmas salary up to the limit of the twelfth part of the annual salary.<\/p>\n
Nor is it subject to taxation, seizure, assignment or sale, by virtue of the aforementioned article 222.<\/p>\n","protected":false},"excerpt":{"rendered":"
