The request was made through a bailiff’s act filed with the Prosecution Directorate of the Public Ministry<\/strong>, in which it is requested to preserve the scene to allow independent expert assessments to be carried out.\n\nAntonio and Maribel Espaillat, along with the company Inversiones E y L, S. R. L.<\/strong>, argue that the preservation of the collapse site, which occurred on April 8, 2025<\/strong>, is essential to guarantee their right to an effective defense.\n\n\n

Among the proposed specialists are Jos\u00e9 M. Lockhart<\/strong>, with more than six decades of experience in forensic analysis of structural failures, and Nicol\u00e1s Saenz<\/strong>, a member of the international firm Thornton Tomasetti<\/strong>, recognized for its participation in investigations of high-impact collapses worldwide.\n\nThe controversy arises after a Preliminary Technical Expert Report<\/strong> requested by the Public Ministry in July 2025, which recommends the immediate demolition of the remains of the building. Faced with this recommendation, the defense argues that the elimination of the structure without an independent analysis would violate fundamental rights.\n\n\n

In a document addressed to magistrate Ernesto Ortiz Reynoso<\/strong>, of the Third Criminal Chamber of the Court of Appeals of the National District, the owners warned that the removal of debris or any modification of the scene would compromise the clarification of the cause of the tragedy.
