His lawyers, Carlos Balcácer, Gustavo Adolfo Biaggi Pumarol and Nelys Rivas, argued that the former official suffers from an adenoma in the left kidney and recurrent kidney stones, conditions that require follow-up and specialized treatment.

The court also pointed out inconsistencies in the inventory of evidence, such as documents in Spanish that did not prove to be official translations and the inclusion of medical records with dates that did not match the list presented. Considering that the base clinical history was flawed, the magistrate concluded that the factual basis supporting the request was not duly proven.

The defense argues that the transfer is due to an urgent medical need and not an attempt to evade justice, pointing out that Rodríguez has faced health issues since his arrest in 2021 and that specialists recommended his evaluation in international centers in Spain. However, the court maintained the current measures, finding insufficient legal support in the documentation presented.

Santo Domingo.- The Second Collegiate Tribunal of the National District denied the request to lift the travel ban from the country presented by the former Attorney General of the Republic, Jean Alain Rodríguez Sánchez, who sought authorization to travel to Madrid, Spain, in order to undergo specialized medical evaluations.
