{"id":502899,"date":"2026-03-24T20:29:23","date_gmt":"2026-03-25T00:29:23","guid":{"rendered":"https:\/\/deultimominuto.net\/en\/uncategorized\/national-congress-approves-elimination-of-independent-candidacies-despite-constitutional-court-ruling\/"},"modified":"2026-03-24T20:31:58","modified_gmt":"2026-03-25T00:31:58","slug":"national-congress-approves-elimination-of-independent-candidacies","status":"publish","type":"post","link":"https:\/\/deultimominuto.com\/en\/dominican-news\/national-congress-approves-elimination-of-independent-candidacies\/","title":{"rendered":"National Congress approves elimination of independent candidacies"},"content":{"rendered":"<strong>Santo Domingo<\/strong>.\u2013 The Chamber of Deputies approved this Tuesday in second reading an organic bill that <strong>eliminates the figure of independent candidacies from the electoral regime<\/strong>, in a decision that has generated questions for contradicting a previous ruling of the Constitutional Court.\n\n\n<p class=\"wp-block-paragraph\">With this measure, the National Congress nullifies articles 156, 157, and 158 of Law 20-23, disregarding the ruling TC\/0788\/2024 issued in December 2024, in which the high court <strong>considered that independent candidacies should not be subject to political parties<\/strong>, but to social entities, as a way to <strong>guarantee the right to political participation.<\/strong><\/p>\n\n\nThe legislative piece, drafted by Senator Rogelio Genao, will be sent to the Executive Branch, where <strong>the President of the Republic will decide whether to enact it or observe it<\/strong>.\n\n\n<h6 class=\"wp-block-heading has-text-align-center\"><strong>You can also read: <a href=\"https:\/\/ab.deultimominuto.net\/nacionales\/diputado-del-prd-en-contra-de-que-se-eliminen-candidaturas\/\" target=\"_blank\" rel=\"noopener\">PRD deputy against the elimination of candidacies<\/a><\/strong><\/h6>\n\n\nThe approval has sparked mixed reactions in the chamber. Congressman Eugenio Cede\u00f1o warned that the decision sets a worrying precedent by ignoring a ruling by the Constitutional Court.\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;This raises a constitutional problem of high relevance, because it opens the door to ignoring a decision of the Constitutional Court simply when it is not liked,&#8221; he expressed.<\/p>\n<\/blockquote>\n\n\nIn the same vein, legislator Ram\u00f3n Raposo considered that, instead of eliminating this figure, Congress should have strengthened it through more robust regulations that expanded democratic participation, even incorporating mechanisms such as a referendum.\n\n\n<p class=\"wp-block-paragraph\"><strong>Defense of the initiative<\/strong><\/p>\n\n\nFor their part, deputies Wandy Batista and Rogelio Genao defended the approval of the project, arguing that the Constitutional Court does not have the power to create laws, but to interpret them.\n\n&#8220;The Constitutional Court cannot usurp the functions of the legislator. The Constitution is clear on who has the power to make laws,&#8221; Genao said.\n\n\n<p class=\"wp-block-paragraph\"><strong>Change of stance<\/strong><\/p>\n\n\nThe decision contrasts with positions previously held by legislative leaders. The Senate President, Ricardo de los Santos, had indicated in 2025 the need to regulate independent candidacies in compliance with the Constitutional Court ruling.\n\nLikewise, deputy El\u00edas Wessin Ch\u00e1vez, who headed a commission to study a law on this figure, now supported its elimination, considering that its implementation would require a constitutional reform.\n\n\n<p class=\"wp-block-paragraph\"><strong>Divided Vote<\/strong><\/p>\n\n\nThe initiative had the majority support of the legislators present, including representatives from the main political parties, among them the Modern Revolutionary Party, the Dominican Liberation Party and Fuerza del Pueblo.\n\nAgainst voted the deputies Ram\u00f3n Raposo, as well as Nelson Vega and Braily Vargas.\n\nThe decision opens a new debate on the scope of the powers of the Legislative Branch in the face of the rulings of the Constitutional Court and its <a href=\"https:\/\/www.youtube.com\/@deultimominutotv\" data-type=\"link\" data-id=\"https:\/\/www.youtube.com\/@deultimominutotv\" target=\"_blank\" rel=\"noopener\">impact<\/a> on the Dominican democratic system.","protected":false},"excerpt":{"rendered":"<p>Santo Domingo.\u2013 The Chamber of Deputies approved this Tuesday in second reading an organic bill that eliminates the figure of independent candidacies from the electoral regime, in a decision that has generated questions for contradicting a previous ruling of the Constitutional Court.
