Santo Domingo.\u2013 The Second Criminal Chamber of the Supreme Court of Justice is hearing this Wednesday the appeal filed by the defense of prosecutor Aurelio Valdez Alc\u00e1ntara, accused of allegedly receiving a 10 thousand dollar bribe from a witness linked to the corruption case at the National Health Insurance (Senasa).<\/p>\n\n\n\n

Valdez Alc\u00e1ntara is in the courtroom while the judges evaluate the appeal filed against the decision of special investigating judge Isis Mu\u00f1iz, who imposed three months of preventive detention on him as a coercive measure.<\/p>\n\n\n\n

The defendant, assigned to the Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption (Pepca), is currently serving the precautionary measure at the Najayo Men’s Correction and Rehabilitation Center (CCR).<\/p>\n\n\n\n

According to the file prepared by the Public Prosecutor’s Office, the prosecutor allegedly received cash from the witness Roberto Cana\u00e1n in the context of the investigations related to the Senasa case.<\/p>\n\n\n\n

In motivating the imposition of the coercive measure, Judge Mu\u00f1iz established that, once the delivery of the money was completed, the action moved to the attempted phase, configuring a situation of flagrancy that compelled the authorities to intervene to secure the evidence and prevent the suspect from leaving the controlled surveillance previously authorized by the competent authority.<\/p>\n\n\n\n

Regarding the search and seizure questioned by the defense, the magistrate indicated that the judicial authorization was specifically directed at the domicile of the investigated party, Aurelio Valdez Alc\u00e1ntara, and highlighted that the defendant’s own lawyers admitted that the proceeding was executed at his residence.<\/p>\n\n\n\n

Regarding the risk of flight, the judge recalled that, in addition to elements such as a fixed address, identification, and professional, social, family, and economic solvency, courts must assess other circumstances directly linked to the punishable act under investigation to determine the need to impose a precautionary measure.<\/p>\n\n\n\n

At the appeal hearing, the Public Prosecutor’s Office is represented by Wilson Camacho, Director General of Prosecution, along with prosecutors Andr\u00e9s Mena and Eduardo Vel\u00e1zquez. The hearing of the appeal is being handled by the Second Criminal Chamber of the Supreme Court of Justice, presided over by Magistrate Francisco Jerez Mena.<\/p>\n\n\n\n
