Santo Domingo.\u2013<\/strong> The senator for the Santo Domingo province, Antonio Taveras, proposed this Wednesday the modification and repeal of several articles of the new Penal Code, with the objective of strengthening freedom of expression, guaranteeing the rule of law, and avoiding excesses in the application of the regulations.<\/p>\n\n\n\n

The independent legislator proposed changes to provisions related to defamation, slander, and the protection of honor, considering that some of the contemplated sanctions could conflict with constitutional principles and international human rights standards.<\/p>\n\n\n\n

Taveras suggested modifying article 208<\/strong>, regarding defamation, so that prison sentences are applied only in cases of false accusations made with malicious intent and to eliminate ambiguous concepts that, in his view, create legal uncertainty.<\/p>\n\n\n\n

“We understand that civil reparation mechanisms should be prioritized over custodial sentences in ordinary cases,” he stated.<\/p>\n<\/blockquote>\n\n\n\n

Likewise, he proposed reforming article 210<\/strong>, regarding slander, to limit criminal intervention to serious and intentional conduct, excluding expressions protected by freedom of opinion and replacing prison sentences with less restrictive sanctions.<\/p>\n\n\n\n

He also requested to adapt article 212<\/strong>, regarding the liability of legal entities in cases of defamation and slander, to prevent the imposition of measures such as the closure of media outlets, suspension of activities, or seizure of equipment as a consequence of offenses related to honor or private life.<\/p>\n\n\n\n

The senator also proposed the repeal of article 310<\/strong>, which sanctions the outrage against public officials or servants.<\/p>\n\n\n\n

As explained, this provision creates a privileged criminal protection for those who exercise public functions.<\/p>\n\n\n\n

“This provision grants a privileged criminal position to public officials over citizens, in contradiction with the constitutional principle of equality before the law,” he maintained.<\/p>\n<\/blockquote>\n\n\n\n

Likewise, he proposed eliminating article 209<\/strong>, which defines extortionate defamation, arguing that this conduct should be addressed within the extortion crimes provided for in article 232<\/strong>, to avoid duplication within the legal system.<\/p>\n\n\n\n

Senate to review proposals<\/h3>\n\n\n\n

Following the legislator’s presentation, the President of the Senate, Ricardo de los Santos, announced the creation of a special commission to review the Penal Code and evaluate proposals that other congressmen may present.<\/p>\n\n\n\n

The new Penal Code was enacted by President Luis Abinader on August 3, 2025, after being approved by the National Congress on July 30 of that same year.
