{"id":511540,"date":"2026-06-17T17:32:27","date_gmt":"2026-06-17T21:32:27","guid":{"rendered":"https:\/\/deultimominuto.net\/en\/uncategorized\/pro-life-coalition-defends-the-new-penal-code-before-the-constitutional-court\/"},"modified":"2026-06-17T17:36:03","modified_gmt":"2026-06-17T21:36:03","slug":"pro-life-coalition-defends-the-new-penal-code-before-the-constitutional-court","status":"publish","type":"post","link":"https:\/\/deultimominuto.com\/en\/uncategorized\/pro-life-coalition-defends-the-new-penal-code-before-the-constitutional-court\/","title":{"rendered":"Pro-life coalition defends the new Penal Code before the Constitutional Court"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Santo Domingo<\/strong>.\u2013 A coalition of civil, religious, and citizen organizations appeared this Wednesday before the Constitutional Court (TC) to defend the protection of life from conception and categorically reject a direct action of unconstitutionality that seeks to decriminalize abortion in the new Penal Code.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a public hearing, the group of voluntary interveners requested that the high court dismiss the lawsuit filed by pro-abortion groups, warning that the attempt to annul the articles that criminalize this practice not only violates the Constitution, but also represents a direct attack on national sovereignty in the face of pressure from international organizations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Defense of the constitutional order and the Penal Code<\/strong><br>The defense counsel, led by lawyer Carmen Orozco Mart\u00ednez, argued that the provisions of the new Penal Code are not arbitrary, but rather the faithful compliance with Article 37 of the Dominican Constitution, which irrevocably enshrines that &#8220;the right to life is inviolable from conception to death&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Through a technical document presented to the magistrates, the organizations detailed the legal balance of the challenged articles:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Articles 106, 107, and 108: Maintain the penalty and sanction for those who professionally cause, cooperate in, consent to, or provoke the interruption of a pregnancy, thus protecting the life of the nasciturus (the unborn).<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>You can read: <a href=\"https:\/\/deultimominuto.com\/nacionales\/coalicion-unidos-por-la-facultad\/\">Coalition United for the Faculty presents program<\/a><\/strong><\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">Article <a href=\"https:\/\/www.youtube.com\/@deultimominutotv\" data-type=\"link\" data-id=\"https:\/\/www.youtube.com\/@deultimominutotv\" target=\"_blank\" rel=\"noopener\">111<\/a> (Therapeutic exemption): It demonstrates that the regulation does not ignore women, as it establishes that medical personnel will not be sanctioned who, after exhausting all available scientific and technical means, interrupt the pregnancy in order to save the life of the mother, the fetus, or both in the face of imminent danger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rejection of foreign interference and judicial overreach<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The participants expressed their deep concern regarding the involvement in this process of organizations such as the United Nations (UN), the Organization of American States (OAS), and international NGOs funded from abroad such as (Human Rights Watch, IPAS, among others), which act as third-party interveners to pressure the Dominican State.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;No international treaty ratified by our country mandates the legalization of abortion. Attempting to have the Constitutional Court create a &#8216;right&#8217; that our Magna Carta expressly prohibits is to usurp the functions of the National Congress and surrender the self-determination of the Dominican people to foreign ideological agendas,&#8221; the representatives of the organizations pointed out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Next steps in the process<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The hearing also included the participation of representatives from the Senate of the Republic, the Chamber of Deputies, and the Public Ministry, who considered the arguments of the petitioners inadmissible.<br>At the end of the debates, the Constitutional Court granted a period of five days to the petitioner to respond to the defenses, after which the pro-life coalition and the State institutions will have an additional period of five days to present their final counterarguments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The organizations concluded their intervention by expressing their confidence that the magistrates of the Constitutional Court will act as guardians of the Magna Carta, shielding the country&#8217;s legal security and reaffirming that in the Dominican Republic, life is respected in all its stages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the intervening organizations are the Archdiocese of Santo Domingo, Pro-Naci\u00f3n, Youth With A Mission (Jucum), RD Inclusiva, Women&#8217;s Forum in Defense of Life and Family (Fomudevi), Mercedes N\u00fa\u00f1ez, Anny Esther Burgos, and the acting lawyer Carmen Orozco Mart\u00ednez.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Santo Domingo.\u2013 A coalition of civil, religious, and citizen organizations appeared this Wednesday before the Constitutional Court (TC) to defend the protection of life from conception and categorically reject a direct action of unconstitutionality that seeks to decriminalize abortion in the new Penal Code.
