Santo Domingo.-<\/em><\/strong> The Second Criminal Chamber of the Court of Appeals of the National District ordered this Monday the removal of the media from the courtroom where the appeal against the dismissal order issued in favor of Jean Andr\u00e9s Pumarol<\/a> Fern\u00e1ndez is being heard, who is accused of homicide, which occurred in the Naco district, as well as causing several injuries.<\/p>n”\n\n“n

The decision was adopted by the judge after the defendant’s defense requested that the hearing be held without the presence of the press, arguing that sensitive aspects related to human dignity and the right to health would be addressed during the process.<\/p>n”\n\n“n

\u201cWe understand that, by virtue of articles 113 to 134 of the Criminal Procedure Code, linked to the issue of human dignity and the right to health, there are very sensitive matters that will be addressed in this hearing,\u201d expressed one of Pumarol’s lawyers.<\/p>n”\n\n“n

The legal representative further argued that the process stems from an intermediate stage and has not yet reached a trial on the merits, which is why they considered it necessary to protect the rights of both the accused and the victims.<\/p>n”\n\n“n

\u201cWe understand that, for the purpose of safeguarding the right that assists the accused party and it is also a matter that assists the victims themselves, this hearing must be developed without the participation of the media, in order to protect the rights of the parties,\u201d he maintained.<\/p>n”\n\n“n

After hearing the request, the magistrate asked the plaintiff if they had any objections. The victims’ representatives responded that they would leave the decision to the court’s discretion.<\/p>n”\n\n“n
