Santiago.<\/strong>\u2013 The Dominican Medical Association (CMD)<\/a>, Santiago branch, held a 24-hour work stoppage this Tuesday at the Jos\u00e9 Mar\u00eda Cabral y B\u00e1ez Regional University Hospital as part of its protest campaign against the provisions of the new Penal Code which, according to the entity, turn situations derived from the practice of medicine into criminal offenses and violate the rights of health professionals.<\/p>\n\n\n\n

The president of the CMD in Santiago, Dr. Pen\u00e9lope G\u00f3mez Batista, reported that the strike is part of a struggle plan initiated this month and asserted that the union rejects the application of a legal framework that, in her view, penalizes doctors for situations that should be addressed in civil jurisdiction.<\/p>\n\n\n\n

The union leader cited as an example the case of a doctor arrested in the province of La Vega, who is facing an accusation of alleged medical malpractice. As she explained, the professional was arrested without the corresponding judicial procedures being exhausted beforehand, which she described as a violation of due process.<\/p>\n\n\n\n

\u201cWe doctors study to preserve life, not to cause harm. We do not seek immunity, but rather that legal procedures be respected and that medical liabilities be handled within the civil jurisdiction, as is the case in other countries,\u201d stated G\u00f3mez Batista.<\/p>\n<\/blockquote>\n\n\n\n

Likewise, he maintained that the new Penal Code includes sanctions that could hold doctors criminally liable for structural deficiencies in public hospitals, such as lack of equipment, breakdowns, or service limitations, situations which, he stated, are beyond the control of medical personnel.<\/p>\n\n\n\n

During the activity, legal representatives of the CMD reported that the detained doctor was arrested at his residence seven months after treating a patient who subsequently filed a complaint for alleged malpractice, without there being, as they claimed, a prior judicial decision to justify the measure.<\/p>\n\n\n\n

Doctor Jos\u00e9 Cruz Corcino stated that the guild is not seeking privileges or impunity, but rather to prevent the professional practice from being criminalized.<\/p>\n\n\n\n

\u201cMedicine is not an exact science. There are procedures whose results are not always as expected, but that does not mean that the doctor should be treated as a criminal,\u201d he stated.<\/p>\n<\/blockquote>\n\n\n\n

Meanwhile, Dr. Wilton Belliard insisted that the detained doctor must be released immediately while the corresponding judicial process takes place, recalling that every person enjoys the right to the presumption of innocence until a court determines liability.<\/p>\n\n\n\n

For his part, the member of the provincial board of the CMD, Dionisio Rodr\u00edguez, warned that the union could intensify protests nationwide if the observations presented to the Penal Code are not accepted.<\/p>\n\n\n\n

\u201cThe attempt to move situations that have traditionally been civil in nature into the criminal sphere represents a threat to the practice of medicine and to the stability of the health system,\u201d he maintained.<\/p>\n<\/blockquote>\n\n\n\n

Similarly, Dr. Ernesto Rodr\u00edguez expressed that the new provisions could generate fear among health professionals, affect medical decision-making, and impact the quality of services offered to the population.<\/p>\n\n\n\n
