The Superintendency of Banks (SB) submitted to the Chamber of Deputies a draft bill that seeks to modernize the procedures for accessing asset information and facilitate the delivery of assets and funds of minor value. The proposal seeks to offer more agile and accessible responses to citizens who face procedures derived from the death of a family member or the dissolution of a marital property regime.<\/p>\n\n\n\n
The initiative was submitted to the President of the Chamber of Deputies, Alfredo Pacheco, for his review and corresponding legislative processing. The proposal arises from a process of technical and institutional analysis led by the Superintendency of Banks, aimed at eliminating barriers that hinder access to patrimonial information and the delivery of certain financial assets in situations of succession, legal community of property, and de facto unions recognized by a final judicial decision.<\/p>\n\n\n\n
Among the main novelties of the preliminary draft is the creation of a simplified procedure for the delivery of low-value movable property, as well as the elimination of formalities and bureaucratic burdens considered unnecessary for citizens. Furthermore, it establishes a clear distinction between the right to know patrimonial information and the right to withdraw funds, strengthening transparency and access to information.<\/p>\n\n\n\n
The proposal also contemplates the reduction of deadlines to access patrimonial information, the limitation of precautionary measures or unjustified oppositions regarding the undivided estate, and the strengthening of the rights of interested parties. Likewise, it promotes the use of more efficient and interoperable systems to continue reducing the administrative burdens associated with these processes.<\/p>\n\n\n\n
Another relevant aspect is the incorporation of a simplified procedure to facilitate access to resources intended to cover funeral expenses and other urgent needs, contributing to the standardization of practices that currently lack specific and uniform regulation.<\/p>\n\n\n\n
The Superintendency of Banks highlighted that the initiative will strengthen the protection of financial users, improve asset transparency, and offer greater legal certainty to financial entities through clear and defined rules, without compromising the confidentiality or stability of the financial system.<\/p>\n\n\n\n
Furthermore, consider that the preliminary draft represents a reform with high social impact, called to fill a long-standing regulatory gap and to guarantee more effective protection of citizens’ rights, especially those who are going through moments of vulnerability derived from the loss of a family member or the termination of assets.<\/p>\n\n\n\n
