Montecristi.<\/strong>\u2013 A man <\/a>who remained for almost two decades in pretrial detention without a final sentence regained his freedom following an intervention by the Public Defense Office of the Judicial Department of Montecristi, which took on his case and managed to reverse the prolonged deprivation of liberty.<\/p>\n\n\n\n

The citizen had been held since June 20, 2006, at the Beller Correction and Rehabilitation Center (CCR) in Dajab\u00f3n, under a precautionary measure that, according to the Public Defense, was extended for years without his judicial situation being defined.<\/p>\n\n\n\n

Upon reviewing the file, the public defenders identified that the inmate had a mental health condition documented through medical reports. Furthermore, they found that in 2009, the technical defense and the Public Prosecutor’s Office had requested the application of a special procedure due to his psychiatric condition.<\/p>\n\n\n\n

However, the request was rejected and the court ordered the suspension of the process until the citizen recovered his mental health status, a decision that ended up prolonging his stay in prison without a definitive resolution of the case.<\/p>\n\n\n\n

Faced with this situation, the Public Defender’s Office initiated legal actions to restore their rights, including a habeas corpus petition and subsequent judicial appeals.<\/p>\n\n\n\n

The process concluded with a Court ruling issued on February 25, 2026, through which the immediate release of the citizen was ordered, putting an end to almost 20 years of preventive detention.<\/p>\n\n\n\n

The national director of the Public Defense, Rodolfo Valent\u00edn Santos, highlighted that the decision represents an important step in the protection of fundamental rights and in the guarantee of due process for people in vulnerable conditions.<\/p>\n\n\n\n

\u201cThis result reaffirms our responsibility to ensure that no person remains invisible within the justice system,\u201d stated Valent\u00edn Santos.<\/p>\n\n\n\n
