La Paz.- <\/strong>A judge rejected the statute of limitations request filed by former Bolivian President Luis Arce, who is accused of alleged corruption while he was Minister of Economy during the government<\/a> of Evo Morales (2006-2019), so he must remain in preventive detention.<\/p>\n\n\n\n

The judicial proceeding took place on Friday and was led by anti-corruption judge Rom\u00e1n Castro, who did not value the arguments presented by Arce (2020-2025), as his lawyer Fernando Rivadeneyra explained to EFE this Saturday.<\/p>\n\n\n\n

“We take this decision as a violation of the laws, the Constitution, the precepts established in the block of conventionality (and) as an affront to human rights,” stated the jurist.<\/p>\n\n\n\n

Rivadeneyra mentioned that the judge committed an “outburst” and issued a “prevaricating ruling” by allegedly failing to consider that the statute of limitations applies after eight years from the event and that, in the case affecting Arce, “more than 16 years have passed” since something that allegedly occurred in 2009.<\/p>\n\n\n\n

The lawyer also accused the judge of exercising “the role of prosecutor” and establishing the alleged economic damage at more than 330 million bolivianos (54.1 million dollars, according to the exchange rate at the time), when “the amount that has been defined did not exceed 7 million bolivianos (1 million dollars).”<\/p>\n\n\n\n

“This judge has not assessed these aspects and, to the detriment of Luis Arce’s rights, has determined that there must be an investigation into amounts that are not directly individualized,” explained Rivadeneyra.<\/p>\n\n\n\n

Luis Arce’s defense in the face of the facts<\/h2>\n\n\n\n

Arce, in preventive detention since December 2025, is being investigated for the alleged crimes of failure to fulfill duties and antieconomic conduct, for allegedly authorizing the disbursement of funds from a development fund to private accounts of leaders of indigenous and peasant organizations for projects that were not executed or were only partially carried out.<\/p>\n\n\n\n

The former president’s defense previously pointed out that the authorization for the transfer of resources was made in compliance with a law regarding the management of State resources and another regarding the operation of the fund, so he could not oppose the compliance with regulations approved by the Parliament of that time.<\/p>\n\n\n\n

The Bolivian Prosecutor’s Office maintains that the proceedings against Arce are for actions he took as a minister and not as president, which is why he is subject to ordinary legal proceedings rather than a special trial of responsibilities.<\/p>\n\n\n\n

The former president filed several requests to obtain his freedom that were denied, while last June his preventive detention was extended for five more months, so he must remain imprisoned until November.<\/p>\n","protected":false},"excerpt":{"rendered":"
