Santo Domingo.-<\/strong> The head of the Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption (Pepca),<\/a> Mirna Ortiz, stated this Wednesday that the request for the extinction of criminal action presented by the defense of former Attorney General Jean Alain Rodr\u00edguez lacks legal basis, reiterating that the expiration of the maximum duration of a process does not, in itself, imply the archiving of the case file.<\/p>\n\n\n\n

During the merits trial hearing, Ortiz explained that first-instance courts, appellate courts, and the Constitutional Court have established that the extinction of criminal action does not operate automatically, but rather it must be evaluated whether there were undue delays attributable to the Public Prosecutor’s Office or the justice system.<\/p>\n\n\n\n

The magistrate cited several judicial decisions, including resolutions from the Third Chamber of the Criminal Court of Appeals, which establish that the use of procedural resources permitted by law does not, in itself, constitute an undue delay that justifies the extinction of the criminal action.<\/p>\n\n\n\n

Ortiz maintained that the jurisprudence has been consistent in pointing out that the computation of the procedural deadline \u201cis not a mathematical calculation,\u201d but rather must be analyzed under the principle of reasonableness, taking into account the complexity of the process, the conduct of the parties, and the particular circumstances of each case.<\/p>\n\n\n\n

\u201cThe requirement that judicial cases be defined within a reasonable timeframe does not respond solely to a quantitative criterion, but also a qualitative one, based on what is fair, proportionate, and equitable,\u201d argued the representative of the Public Prosecutor’s Office during her intervention.<\/p>\n<\/blockquote>\n\n\n\n

Ortiz’s statements come as the Second Collegiate Court of the National District hears an incident presented by Rodr\u00edguez’s defense, which seeks to have the criminal action declared extinguished due to the alleged expiration of the maximum duration of the process. The Public Prosecutor’s Office maintains that this request has been previously rejected and that the trial must continue until a decision on the merits is reached.<\/p>\n\n\n\n

As part of the context of the process, the Public Prosecutor’s Office accuses Jean Alain Rodr\u00edguez and other defendants of being part of an alleged corruption network that reportedly embezzled more than RD$6 billion through alleged irregularities committed between 2016 and 2020, when he served as Attorney General of the Republic.
