Science Desk.- <\/strong>Artificial intelligence<\/a> enters a critical phase in Europe, and most of the obligations set out in the European Regulation\u2014the world’s first law to regulate the use of these systems\u2014come into effect on August 2nd.<\/p>\n\n\n\n

The European regulation, which was approved in 2024 and provides for a staggered implementation until 2028, establishes a common framework for AI to be used in the EU in a safe, transparent, and respectful manner regarding fundamental rights, and requires technical and ethical control of all these tools to mitigate risks.<\/p>\n\n\n\n

The sanctioning regime provides for multi-million euro fines: up to 35 million euros in the case of very serious ones, for using, for example, prohibited AI systems; or 15 million in the case of serious ones, for non-compliance related to systems classified as “high-risk”.<\/p>\n\n\n\n

Systems that entail unacceptable risks have already been prohibited since last year, and among them are those that use subliminal, manipulative, or deceptive techniques; those that seek to exploit the vulnerability of individuals (minors, the elderly, or the disabled); those that use biometric categorization to infer race, religion, or sexual orientation; or systems that use \u2018social scoring\u2019 to evaluate behavior.<\/p>\n\n\n\n

AI systems that infer emotions in workplaces or educational settings are also now prohibited in the EU; as is the scraping of images from the internet to create facial databases; or remote, real-time biometric identification in public spaces for law enforcement purposes.<\/p>\n\n\n\n

Sexual \u2018deepfakes\u2019 and child pornography<\/p>\n\n\n\n

And to these \u2018unacceptable\u2019 tools, some of the worst uses of generative AI have just been added as prohibited systems\u2014although they will not come into effect until next December\u2014such as the creation or manipulation of intimate content without consent (\u2018sexual deepfakes\u2019) or any capable of generating child pornography.<\/p>\n\n\n\n

Marked as the turning point of the Regulation, on August 2nd the bulk of the rule begins to apply: all transparency obligations, the rules regulating most AI systems, and the obligations of providers and users, but the European Commission has approved a rule (Digital Omnibus) to simplify the complex ecosystem of digital laws and attempt to make their application more gradual and coordinated.<\/p>\n\n\n\n

And it postpones, until December 2027, some of the most significant points of the law, including the demanding obligations that must be met by AI systems classified as ‘high-risk’ (for example, those used to evaluate or grade students, to filter resumes, to assess the financial solvency of individuals, or to set the price of life or health insurance).<\/p>\n\n\n\n

The obligation to inform any user that they are interacting with an AI system does come into effect on August 2nd, but not the mandatory labeling of content generated with AI tools (with a watermark featuring the acronym AI), which has been postponed until December 2nd for those systems capable of generating synthetic content (images, videos, or audio that imitate real elements or people).<\/p>\n\n\n\n

It will take two more years (August 2028) for all obligations regarding artificial intelligence systems, also classified as ‘high-risk’ but integrated into products or services already regulated (such as medical devices, driving assistants, toys, or air navigation assistants), to come into effect.<\/p>\n\n\n\n

Added to the complex European legislative framework is the bill for the proper use and governance of AI that has been approved by the Spanish Government (currently being processed in Congress), which seeks to adapt the European regulation to the Spanish framework, which in no case establishes a parallel regime but does specify it, develops it, organizes who supervises, how it is sanctioned, or how this tool should be used in the public sector.<\/p>\n\n\n\n

Regulation versus innovation?<\/h3>\n\n\n\n

Specialists in law and digital transformation have analyzed with EFE the legal framework and the complex implementation schedule of the European AI Act.<\/p>\n\n\n\n

The CEO of the company BIP Iberia -a consultancy firm specializing in adaptation to digital markets-, Giovanni Alessandrello, has pointed out that the greatest risk is that companies interpret the extensions “as an invitation to wait”.<\/p>\n\n\n\n

Speaking to EFE, Alesandrello assessed the regulation as “a test of maturity” because any AI system must be able to be “explained, governed, and audited,” and he rejected the “false” dichotomy that he believes exists, which suggests that the United States has chosen innovation while Europe has chosen regulation, or that these types of rules hinder European innovation and competitiveness.<\/p>\n\n\n\n

“The question is not whether we should regulate AI; the challenge is how to govern it without stifling innovation, because without control it can generate systemic risks, but excessively rigid regulation can prevent Europe from competing. The challenge is to find the balance,” he stated.<\/p>\n\n\n\n

Technology and digital rights lawyer Guillermo Hidalgo, from the firm Maio Legal, perceives that the Regulation provides clear rules, because regulating a customer service chatbot is not the same as a system that decides whether you are granted a loan, and he has expressed his conviction that the regulation can be “a seal of quality for European AI”.<\/p>\n\n\n\n

Hidalgo, in statements to EFE, has warned that technology is advancing faster than regulation and it is foreseeable that systems will appear with a real impact on people that fall outside of those already classified as ‘high risk’, or due to the confusion and complication that the implementation schedule or the overlap with other regulations (such as data protection) already in force may pose for many companies.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"
