Santo Domingo.<\/strong> \u2013 Criminal lawyer F\u00e9lix Portes warned that the new Dominican Penal Code<\/a> contains provisions that could raise constitutional questions, especially regarding the increase in penalties and the accumulation of sentences, which would allow for up to 60 years of imprisonment.<\/p>\n\n\n\n

During an interview, Portes stated that, although he considers it necessary to update legislation that dated back to 1884, one of the aspects that worries him most about the new regulations is the significant increase in sanctions, without sufficiently taking into account the principle of social reintegration.<\/p>\n\n\n\n

\u201cThere is a tendency, when you read article by article, toward a significant increase in penalties,\u201d he stated.<\/p>\n<\/blockquote>\n\n\n\n

The jurist pointed out that the accumulation of sentences constitutes one of the points that should be reviewed, understanding that a sentence of several decades can become, in practice, a penalty equivalent to life imprisonment.<\/p>\n\n\n\n

\u201cWhen you talk about a person being sentenced to 60 years in prison due to the accumulation of sentences, that person has no opportunity to reintegrate into society. It is a life sentence or a life sentence in disguise,\u201d he maintained.<\/p>\n<\/blockquote>\n\n\n\n

During the interview granted to the radio program Esto No Tiene Nombre<\/em>, on La Nota 95.7 FM, Portes explained that a person sentenced to 60 years in prison, depending on the age at which they receive the sentence, could spend the rest of their life deprived of liberty, which, in his view, contradicts the constitutional mandate that the penalty should be oriented toward the re-education and reintegration of the convicted person.<\/p>\n\n\n\n

In that sense, he proposed that the commission in charge of reviewing the legislation evaluate, as soon as possible, the provisions related to the accumulation of sentences and the maximum penalty, considering that they could conflict with the Dominican Constitution and with international treaties signed by the country.<\/p>\n\n\n\n

Alternatively, he proposed maintaining the criterion of sanctioning each criminal act committed, but that the applicable penalty should be based on the most serious of the offenses, instead of accumulating sentences that could lead to extremely long prison terms.<\/p>\n\n\n\n

However, Portes acknowledged that the new Penal Code represents a necessary modernization of the Dominican legal system, by incorporating new criminal offenses and gathering in a single legal body crimes that were previously scattered across different special laws.<\/p>\n","protected":false},"excerpt":{"rendered":"
