Los Angeles.- <\/strong>A U.S. appeals court rejected on Monday the argument from Meta, Google, TikTok, and other social media companies regarding a 1996 law that would grant them immunity, meaning that more than 3,000 lawsuits against them for designing products that caused addiction in children and young people should be dismissed.<\/p>\n\n\n\n

The U.S. Ninth Circuit Court of Appeals, based in San Francisco (California), dismissed this Monday the appeal filed by social media parent companies to overturn a previous ruling by a federal judge in Los Angeles, which allowed thousands of lawsuits against tech companies to proceed, including those filed by several states.<\/p>\n\n\n\n

In their appeal, Google (Alphabet), Meta (parent company of Facebook and Instagram), Snap (owner of Snapchat), and TikTok (ByteDance) argued that Section 230 of the Communications Decency Act protected them from being sued for failing to warn the public that social media can cause addictive behaviors.<\/p>\n\n\n\n

The judge’s decision<\/h3>\n\n\n\n

Judge Jacqueline Hong-Ngoc Nguyen wrote in the decision that the court \u201cdoes not agree\u201d with the tech companies’ arguments and that the law does not specify in which scenarios immunity applies.<\/p>\n\n\n\n

The appeals court also denied Meta’s request to postpone a trial in a lawsuit filed by 19 states that begins this Wednesday in a federal court in Oakland.<\/p>\n\n\n\n

In the lawsuit, it is argued that Meta, among other things, designed and implemented harmful features on its platforms that create addiction in children and adolescents \u2014causing them serious physical and mental harm\u2014, while deceiving the public about the existence and severity of these risks.<\/p>\n\n\n\n

The ruling represents a new setback for Meta, after a district court in Santa Fe, New Mexico, ordered the tech giant last week to pay $567 million into a youth mental health reparation fund that it must create, because its way of operating is considered to harm the health and safety of adolescents.<\/p>\n\n\n\n
