Other people on board the boat informed the governor of the incident,&#8221; the document states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The governor considers that the act was <a href=\"https:\/\/www.swissinfo.ch\/spa\/multan-a-una-persona-en-noruega-por-despertar-a-un-oso-polar-con-la-sirena-de-un-barco\/91892653\" data-type=\"link\" data-id=\"https:\/\/www.swissinfo.ch\/spa\/multan-a-una-persona-en-noruega-por-despertar-a-un-oso-polar-con-la-sirena-de-un-barco\/91892653\" target=\"_blank\" rel=\"noopener\">&#8220;disturbing&#8221; <\/a>to the bear and that it was intentional, hence why he issued a fine for violating environmental laws, which has already been paid by the offender.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Located in the Arctic Circle, the Svalbard archipelago is under Norwegian sovereignty, but a 1920 treaty allows all signatory countries -nearly 40- to exploit its natural resources.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Laws of Norway<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The person must pay 50,000 Norwegian kroner for deliberately disturbing the animal in the Svalbard archipelago<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person was fined <strong>50,000 Norwegian kroner<\/strong>, about <strong>US$5,255<\/strong>, after using a ship&#8217;s siren to deliberately wake up a polar bear that was sleeping on land in the Svalbard archipelago, in the Norwegian Arctic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The incident occurred this month in <strong>Lomfjorden, in Hinlopenstretet<\/strong>, when the occupants of a vessel observed the animal resting on land. One of the people on board sounded the ship&#8217;s horn, causing the bear to wake up and move to another location.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The crew themselves subsequently reported the incident to the Governor of Svalbard, the authority responsible for the administration of the territory. After investigating the case, the authorities determined that the action had been <strong>intentional<\/strong> and constituted a disturbance of the polar bear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The person accepted the fine and has already made the payment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does Norwegian law say?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The case occurred in Svalbard, a Norwegian territory with particularly strict environmental regulations due to the importance of its ecosystems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Svalbard Environmental Protection Act<\/strong> states that it is prohibited to <strong>unnecessarily disturb, attract, or pursue polar bears<\/strong>. The legislation also establishes restrictions for approaching these animals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Precisely, the Governor of Svalbard determined that the use of the siren to wake the bear constituted conduct prohibited by <strong>section 30, letter a, first paragraph, of the Svalbard Environmental Act<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The regulation does not need to specify that it is forbidden to \u201cwake a bear with a siren.\u201d The conduct can be sanctioned because it deliberately causes an unnecessary disturbance to the animal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Special protection for polar bears<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The polar bear is subject to special protection in Svalbard. Authorities seek to prevent human activities from altering the natural behavior of these animals or forcing them to abandon areas where they rest, feed, or travel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation also establishes that people cannot travel or remain within <strong>300 meters of a polar bear<\/strong>, according to the applicable environmental provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The regulation reflects a fundamental premise: <strong>observing a wild animal does not mean having authorization to interact with it<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, the person did not need to physically approach the bear to violate the rules. The intentional use of the horn was considered sufficient to disturb it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A fine that seeks to prevent this type of behavior<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Svalbard authorities have warned on several occasions about the obligation to maintain an adequate distance from polar bears and to avoid any behavior that could alter their conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case demonstrates that environmental regulations can be applied even when the action does not cause injury to the animal.
