Lima.- <\/strong>The Peruvian Justice system<\/strong> annulled the money laundering trial against Nadine Heredia, the wife of former president Ollanta Humala (2011-2016)<\/strong> who is currently seeking asylum in Brazil, and overturned, as it did with her spouse, the 15-year prison sentence she received for alleged illegal contributions to the former leader’s electoral campaigns.<\/p>\n\n\n\n

The information was revealed this Thursday by Heredia’s lawyer, Wilfredo Pedraza,<\/strong> who pointed out that the Second National Criminal Appeals Chamber<\/a><\/strong> issued an exceptional order declaring the “constitutional nullity” of the entire money laundering process against Humala and extended it “to all persons included in that process.”<\/strong><\/p>\n\n\n\n

“Thus ends more than 11 years of pure arbitrariness”<\/strong>, Pedraza expressed on his X social network account, where he shared the resolution of the Appeals Chamber.<\/p>\n\n\n\n

In its resolution, the court recalled that the Constitutional Court declared well-founded a habeas corpus lawsuit filed by Humala and ordered his release after annulling the entire criminal proceeding against him, a measure that was executed on July 31.<\/p>\n\n\n\n

In this sense, on this occasion, it declared well-founded the requests for the extension of effects presented in favor of Heredia, her mother Antonia Alarc\u00f3n, her brother Il\u00e1n Heredia<\/strong>, former congressman Santiago Gasta\u00f1adui, and five other people involved in the management of campaign funds for the Nationalist Party, founded by Humala and his wife.<\/p>\n\n\n\n

The chamber ordered the definitive archiving of the criminal proceedings and the lifting of arrest warrants, requisitions, personal restrictions, and coercive measures derived from the trial against those previously accused.<\/p>\n\n\n\n

The money laundering case against Humala was based on the alleged irregular financing of his 2006 and 2011 electoral campaigns for failing to declare supposed monetary contributions from Chavismo and the Brazilian construction company Odebrecht, respectively, which led to him being sentenced to 15 years in prison.<\/p>\n\n\n\n

However, the Constitutional Court (TC) established last July that the entire process lacked validity because the concealment of donations for electoral campaigns was not considered a crime at the time of the events, and the Prosecutor’s Office had also failed to establish the necessary considerations to constitute money laundering in those operations.<\/p>\n\n\n\n

Upon leaving the Barbadillo prison, the facility built in Peru exclusively to house former presidents, where Alejandro Toledo (2001-2006), Mart\u00edn Vizcarra (2018-2020), and Pedro Castillo (2021-2022) currently remain, Humala said they had been “victims of political and judicial persecution.”<\/p>\n\n\n\n

“On April 15, 2025 (when I was sentenced) I was kidnapped by the State,” he asserted.<\/p>\n\n\n\n

Humala complained that, as a result of the sentence, he had to grant asylum to his wife in Brazil, where she has been since April 2025, and take his children out of the country.<\/p>\n\n\n\n

Additionally, the former president was also held in pretrial detention for the same case for ten months between 2017 and 2018, a measure that was also revoked by the Constitutional Court at the time.<\/p>\n\n\n\n

Following the ruling in favor of Humala, the president of Peru, Keiko Fujimori, who also benefited in a similar case thanks to a Constitutional Court resolution, stated that her country lives “in a rule of law” and the order that released her former electoral rival had to be complied with.<\/p>\n\n\n\n

The judicial case of Nadine Heredia and Ollanta Humala in Peru<\/h3>\n\n\n\n

The case against Nadine Heredia and Ollanta Humala<\/strong> dates back to investigations into the financing of the Peruvian Nationalist Party’s electoral campaigns in 2006 and 2011<\/strong>. The Prosecutor’s Office maintained that the group received contributions of illicit origin that were subsequently incorporated into the financial system, which led to the accusation of money laundering. In April 2025, the Peruvian Judiciary sentenced both to 15 years of effective imprisonment<\/strong> for aggravated money laundering.<\/p>\n\n\n\n

The ruling pointed out that during the campaigns there were contributions that were not acknowledged by several of the alleged donors. For the 2006 campaign, the court identified 1.574 million soles in unacknowledged contributions<\/strong>, while for the 2011 campaign it determined that another 4.329 million soles<\/strong> corresponded to contributions that were also not acknowledged by those listed as contributors.
