{"id":521654,"date":"2026-08-14T20:20:45","date_gmt":"2026-08-15T00:20:45","guid":{"rendered":"https:\/\/deultimominuto.net\/en\/uncategorized\/preventive-detention-for-driver-charged-with-causing-traffic-accident-that-left-three-dead-in-los-rios\/"},"modified":"2026-08-14T20:20:45","modified_gmt":"2026-08-15T00:20:45","slug":"preventive-detention-for-driver-charged-with-causing-traffic-accident-that-left-three-dead-in-los-rios","status":"publish","type":"post","link":"https:\/\/deultimominuto.com\/en\/uncategorized\/preventive-detention-for-driver-charged-with-causing-traffic-accident-that-left-three-dead-in-los-rios\/","title":{"rendered":"Preventive detention for driver charged with causing traffic accident that left three dead in Los R\u00edos"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>SANTO DOMINGO.- <\/strong>At the request of the Public Ministry, a court in the National District imposed <a href=\"https:\/\/deultimominuto.com\/nacionales\/tres-personas-mueren-atropelladas\/\">preventive prison<\/a>, as a coercive measure, on a man accused of causing a traffic accident in which three people died, including a minor, during an incident that occurred in the Los R\u00edos sector on August 5, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Manuel Joaqu\u00edn Pay\u00e1n Morales must serve two months of preventive detention at the Najayo Men&#8217;s Correction and Rehabilitation Center (CCR-17) by order of the Fourth Chamber of the Special Traffic Court of the National District.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the request submitted by public prosecutor Alcedo Magar\u00edn, the defendant was driving a 2019 Chevrolet Colorado pickup truck while intoxicated when he struck the victims on Coronel Juan Mar\u00eda Lora Fern\u00e1ndez Avenue, at the corner of Rep\u00fablica de Colombia Avenue, near a gas station in the National District.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a consequence of the impact, Dieufort Gesner, of Haitian nationality, passed away, as well as two other people, a woman and a minor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>We recommend reading:<a href=\"https:\/\/deultimominuto.com\/nacionales\/mujer-permanece-estado-critico\/\">Woman remains in critical condition after hit-and-run that left two dead in Los R\u00edos<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the hearing, the Public Prosecutor&#8217;s Office presented various documentary evidence linking the defendant to the events, including the traffic report filed by the General Directorate of Traffic and Land Transportation Safety (Digesett), the flagrant arrest report, the death certificate issued by the National Institute of Forensic Sciences (Inacif), and the identification documents of the driver and the vehicle involved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, the breathalyzer test performed on the defendant was incorporated, which yielded a result of 0.91 milligrams of alcohol per liter of exhaled air, a level that far exceeds the limit permitted by Law 63-17 on Mobility, Land Transportation, Traffic and Road Safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When assessing the evidence provided, the court considered the defendant&#8217;s connection to the investigated facts to be reasonable and concluded that pretrial detention constitutes the most suitable measure to ensure the development of the investigation and the clarification of the circumstances of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>The Public Prosecutor&#8217;s Office granted the case the provisional legal classification of violation of articles 256, 303, numeral 5, and 304, numeral 2, of Law 63-17.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mandatory review of the measure was set for October 12, 2026, at 9:00 in the morning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judge Elianny Mena Ure\u00f1a, of the Fourth Chamber of the Special Traffic Court of the National District, imposed the coercive measure against the defendant.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>SANTO DOMINGO.- At the request of the Public Ministry, a court in the National District imposed preventive prison, as a coercive measure, on a man accused of causing a traffic accident in which three people died, including a minor, during an incident that occurred in the Los R\u00edos sector on August 5, 2026.
