Santo Domingo.-<\/strong> The defense for former Attorney General of the Republic Jean Alain Rodr\u00edguez<\/strong> announced this Monday that it will appeal the decision of the Second Collegiate Court of the National District<\/strong> which rejected the request for the extinction of the criminal action in the alleged administrative corruption case he is facing.<\/p>\n\n\n\n

In a statement, the former official’s defense counsel stated that the court’s decision recognizes that the process has been prolonged for almost six years, that the maximum period provided for by procedural legislation is four years, and that neither Rodriguez nor his lawyers caused the delays in the case.<\/p>\n\n\n\n

However, the defense argued that the court erred in considering that, despite the expiration of the legal deadline, the so-called “reasonable time”<\/strong> had not been violated, understanding that both concepts are distinct.<\/p>\n\n\n\n

The former attorney general’s lawyers argued that the Constitutional Court’s jurisprudence and Law 97-25 establish that the reasonable time frame coincides with the four-year legal limit, which is why they consider that the criminal action should be declared extinguished.<\/p>\n\n\n\n

Consequently, they announced that they will appeal the decision before the Court of Appeal, asserting that a higher jurisdiction must resolve the legal controversy regarding the interpretation of the maximum duration of the process.<\/p>\n\n\n\n

The former attorney general and 16 other people are accused of being part of an alleged corruption network that, according to the Public Prosecutor’s Office, embezzled more than 6 billion pesos during his tenure at the head of the Attorney General’s Office between 2016 and 2020.<\/p>\n\n\n\n
