New York.\u2013<\/strong> New York<\/strong> tenants facing risky situations due to a lack of basic services, broken elevators, or conditions that have forced the evacuation of buildings will have a faster path to file claims with the city’s Housing Court<\/a>.<\/p>\n\n\n\n

The new modality seeks to reduce long wait times, which can extend for months and even years, especially in processes related to properties that present serious maintenance problems. Files that meet the established requirements will be assigned to a judge on the same day they are submitted.<\/p>\n\n\n\n

Once the corresponding notification has been made, owners and tenants will have a maximum of five days to appear before the court. The provision does not imply that the conflict will necessarily be resolved within that period, but it does establish a more agile judicial procedure to address situations considered of greater urgency.<\/p>\n\n\n\n

New York prioritizes cases<\/h2>\n\n\n\n

Among the cases that will receive priority in New York<\/strong> <\/a> are buildings with eviction orders affecting at least one-third of their apartments or the entire property. Also included will be those in which a similar proportion of housing units remain without essential services, such as water, heating, hot water, electricity, or gas, due to a violation considered an immediate hazard.<\/p>\n\n\n\n

The expedited procedure will also cover properties where all elevators are out of service. Likewise, certain processes under the so-called Article 7A, used when the city or residents ask a judge to place a building’s management in the hands of a third party due to severe deterioration and persistent lack of maintenance by the owner, may also qualify for this route.<\/p>\n\n\n\n

To respond to the increase in files that could qualify for the new mechanism, the Unified Judicial System will expand the number of judges available to hear housing cases and processes linked to Article 7A.<\/p>\n\n\n\n

New York expands response<\/h3>\n\n\n\n

Mayor Zohran Mamdani’s administration maintains that the change will allow for greater pressure to be exerted on landlords to comply with repairs and safety standards, without limiting their right to present arguments and defend themselves during the judicial process.<\/p>\n\n\n\n

The initiative is part of a broader strategy to improve rental housing conditions in New York<\/strong>. Among other provisions, the city established that landlords must offer alternative accommodation to residents when a building remains without elevator service for more than 14 days and the necessary work to restore it is not being carried out.<\/p>\n\n\n\n

The municipal budget also includes US$14.3 million for fiscal year 2027 and US$40 million annually thereafter<\/strong>, with the purpose of expanding the legal representation available to tenants facing housing-related proceedings.<\/p>\n","protected":false},"excerpt":{"rendered":"
