The NGO Women’s Link has submitted an urgent communication to six special mechanisms of the United Nations (UN) to request their intervention in the case of the two former employees of singer Julio Iglesias due to “fear of reprisals.” The former employees reported having suffered abuse at his residences in the Bahamas and the Dominican Republic in 2021.<\/p>\n\n\n\n
The action before the international body comes after the complaint filed on September 3rd with the Instruction Section of the Spanish Central Court of Instruction, as reported by the organization itself, which accompanies and represents the complainants in the process.<\/p>\n\n\n\n
The artist’s lawyer, Jos\u00e9 Antonio Chocl\u00e1n, indicated in statements to Europa Press last week that they have no “formal notice” that the lawsuit has been filed. “In any case, the lack of Spanish jurisdiction has already been declared. We cannot say much more,” he concluded.<\/p>\n\n\n\n
Now, the urgent communication has been directed, among other mandates, to the Special Rapporteur on violence against women and girls, the Working Group on discrimination against women and girls, as well as the Special Rapporteur on contemporary forms of slavery and human trafficking.<\/p>\n\n\n\n
Through this document, the entity conveys its “concern that the Spanish State is not fulfilling its obligations to investigate the reported facts.”<\/p>\n\n\n\n
Therefore, it urges the rapporteurs to request information from the Spanish Government on how it will guarantee an “effective and independent investigation” and to demand that the procedure be addressed from an “intersectional gender perspective”.<\/p>\n\n\n\n
One of the central axes of the request lies in the need to articulate “urgent protection measures” for the complainants –who have taken the fictitious names of Rebeca and Laura–, their families, and the potential witnesses in the case, given the “fear of reprisals” expressed by the plaintiffs.<\/p>\n\n\n\n
The defense maintains that “the gravity of the reported facts, the economic and social power position of the defendant, as well as the current lack of State protection” increase the vulnerability of the complainants.<\/p>\n\n\n\n
In this sense, they warn of a “structural concern regarding access to justice for migrant domestic workers,” arguing that factors such as their migratory, racial, or economic status cannot become “obstacles to accessing justice or to the complaint being investigated with due diligence.”<\/p>\n\n\n\n
The organization recalls that “it would not be the first time that an international body points out failures of the Spanish State in its duty of due diligence”.<\/p>\n\n\n\n
In that sense, it cites the resolution of the CEDAW Committee in 2014 for the ‘\u00c1ngela Gonz\u00e1lez Carre\u00f1o case’ and the conviction issued in October 2024 by the European Court of Human Rights (ECHR) in the ‘T.V. v. Spain case’, where the violation of Article 4 of the European Convention on the prohibition of slavery and forced labor was confirmed for failing to act with due diligence in the initial investigation.<\/p>\n\n\n\n
