New York.-<\/strong> Lindsay Clancy,<\/strong> accused of the murder of her three children -Cora, 5; Dawson, 3, and Callan, 8 months-, returned to court this Tuesday<\/strong> for a hearing that will address the future of the case following the mistrial declared in early September.<\/p>\n\n\n\n

Clancy’s defense has requested the judge, William Sullivan<\/strong>, to dismiss the charges against her, arguing that the prosecution did not present sufficient evidence to prove her guilt.<\/p>\n\n\n\n

The trial against the woman was declared a mistrial on September 4th<\/strong> after the jury failed to reach a unanimous verdict, and now, the prosecution and her lawyers must decide whether to face a new trial, negotiate a plea deal, or end the proceedings.<\/p>\n\n\n\n

Clancy’s attorney, Kevin Reddington<\/strong>, then argued in an emergency hearing that a juror was not following deliberation instructions and was therefore blocking a verdict that would have been unanimous.<\/p>\n\n\n\n

His defense is now requesting an investigation into this juror, Michael Desronvil, who was the only one to vote in favor of finding Clancy guilty of the charges.<\/p>\n\n\n\n

Specifically, his lawyers are requesting that the judge question Desronvil and are asking for access to court documents regarding an alleged lawsuit for mistreatment filed by his ex-wife, which was subsequently dismissed.<\/p>\n\n\n\n

Lindsay<\/strong>, a 36-year-old former nurse, was accused of strangling her children Cora, 5; Dawson, 3, and Callan, 8 months, in January 2023 at her home in Duxbury, Massachusetts, after which she attempted suicide and was left partially paralyzed.<\/h3>\n\n\n\n
