The Regulatory Commission for Unfair Trade Practices and Safeguard Measures (CDC) decided not to apply a provisional safeguard measure on imports of sweet and savory biscuits, concluding that the evidence available at this stage of the investigation does not demonstrate the existence of serious injury or an imminent threat that would justify such action.
The decision is contained in Resolution No. CDC-RD-SG-020-2026, dated July 8, 2026, published this Thursday through a public notice, in which the institution specifies that the investigation will continue until all phases of the administrative procedure are exhausted.
The process was initiated following a request submitted by the companies Molinos Modernos, S.A. and Molinos Valle del Cibao, S.A., domestic biscuit manufacturers, who allege that the increase in imports has affected local production.
During the preliminary evaluation, the Commission verified that imports of the investigated product recorded sustained growth between 2022 and 2025, mainly from India, Peru, Mexico, and Colombia. However, it maintained that the evidence gathered so far does not constitute sufficient proof to meet the requirements established in Law 1-02 on Unfair Trade Practices and Safeguard Measures to impose a provisional measure.
The agency explained that, although some indicators of the national industry show signs of deterioration, these must be analyzed in greater depth during the course of the investigation to determine if there is a causal relationship between the increase in imports and the alleged injury to the domestic production branch.

As part of the procedural calendar, the CDC has scheduled a public hearing for August 11, 2026. The evidentiary period will conclude on August 25, the evidentiary hearing will be held on September 16, the parties’ closing arguments must be filed by September 28, and the final resolution is scheduled for November 2026.
The Commission reported that all documentation related to the file and procedural actions will be available for public consultation through its institutional portal during the course of the investigation.
