New York .- The U.S. Department of Justice sued the state of Minnesota on Monday for allowing transgender girls to participate in women’s sports, which they allege constitutes discrimination “on the basis of sex” and violates federal law.
The lawsuit accuses the state’s Department of Education and the state high school league of having engaged in “flagrant” sexual discrimination by “forcing young women to compete against boys in sports competitions intended exclusively for women and to share intimate spaces, such as locker rooms and shared bathrooms.”
The Administration’s argument is based on an executive order from President Donald Trump, from February 2025, called ‘Excluding Men from Women’s Sports’ which does not recognize trans people with the gender they identify with, but with the one assigned at birth.
Thus, sex is defined only in biological terms and serves as the basis for alleging discrimination “on the basis of sex”, which is prohibited by Title IX, a 1972 federal law.

“Minnesota disregards this in favor of so-called ‘gender identity,’ a decision that prioritizes ideology over biology, equity, and safety,” they allege in the lawsuit.
They denounce lack of fair competition
“The Trump administration does not tolerate erroneous state policies that ignore biological reality and unfairly harm girls on the playing field,” said Attorney General Pam Bondi in a statement.

For this case, the Prosecutor’s Office collaborated with the Department of Health and Human Services (HHS) and the Department of Education. “We will not allow girls to be denied equal opportunities and basic privacy,” stated Health Secretary Robert Kennedy, Jr.
For her part, Education Secretary Linda McMahon accused Minnesota’s policies of “denying athletes fair competition” and undermining “their right to equal access to educational activities.”
According to reports, the state Department of Education receives $3 billion in federal funds that are conditioned on compliance with Title IX.
This is a new attempt by the Trump Administration to take to court and pressure to cut funds to states or institutions that do not follow its political line, in this case those that maintain an inclusive policy in school sports that allows trans people to compete on the team that corresponds to them by their gender identity.
