The Provincial Court of Almería has sentenced a music teacher to one year and six months in prison for sexual harassment of a 14-year-old student, according to reports this Saturday by the EFE Agency. The ruling, issued after overturning a previous acquittal, includes the obligation to compensate the victim with 8,000 euros for moral damages and the prohibition of approaching and communicating with the minor for four years. The incident took place on March 12, 2024, at a music school. During an exam, according to the proven facts, the interim teacher told the student: “If you show me your breasts, I’ll pass you.”

When confronted by the minor, who reminded him of his age, the professor insisted, justifying his comment and wondering why men can go shirtless and women not. Faced with the student’s discomfort, the accused assured that it was a joke and asked her “not to tell her parents to prevent the Police from arresting him“.Initially, the Criminal Court number 4 of Almería acquitted the teacher. The magistrate maintained that, although the comment caused “perplexity” in the minor, the school context and the school hours did not generate a climate of “hostility” that would force the victim to feel that she had to accede to the request to avoid negative consequences.
