New York .- Judge Gregory Carro, who is presiding over the state case in New York against Luigi Mangione, postponed this Monday the trial for the murder of UnitedHealthcare CEO Brian Thompson, which was scheduled for September, and called a hearing for December 10.
The start of jury selection in the state trial was scheduled for September 8, but Carro ordered the next hearing for December 10 so that the Prosecution can respond to the request by Mangione’s lawyers to dismiss the case, arguing double jeopardy.
Mangione’s defense filed that motion after he pleaded guilty last Friday to two federal stalking charges related to the murder of Thompson, who was leading the largest health insurance company in the U.S. when he was shot to death by the subject in Manhattan in December 2024.
The defense’s request
Mangione said in court that part of his motivation for shooting Thompson was the severe back pain he was facing after a vertebral fracture and his frustration with the insurance system.
Carro ordered the Prosecutor’s Office to respond to the defense’s motion before October 9 and summoned the defense to answer those arguments before October 30, followed then by the hearing on December 10.

Mangione, 28, will be sentenced for the federal case on December 18, and the Prosecution requested that he be given a sentence of between 16 and 30.5 years.
