Santo Domingo.– The lawyer for Jean André Pumarol Fernández, Richard Martínez, reported this Thursday that the defense will appeal the decision of the Second Chamber of the Criminal Court of Appeals of the National District, which revoked the dismissal order and ordered the opening of a trial against his client.
Although he expressed his disagreement with the ruling, the jurist assured that they respect the court’s decision and will comply with the provisions issued by the Court.
“We clearly do not agree with the decision, but we are respectful of what the courts say. We are going to appeal in due course,” he expressed.
Martínez explained that, following the judicial decision, Pumarol will be handed over to the authorities to comply with the imposed coercive measure, noting that he is currently admitted to a health center.
“Right now it is time for him to turn himself in to comply with what was ordered by the Court. He is in an internal clinic and he is going to turn himself in,” he pointed out.

The lawyer also expressed concern about the conditions in which his client might be held, considering that the centers intended for inmates with mental disorders do not offer the necessary guarantees to preserve his integrity.
“The integrity of the defendant must be protected. Without the defendant, there is no trial. In a facility like the one in Higüey, where there is supposedly a psychiatric area, the minimum requirements to care for a person with a mental condition are not met,” he stated.

Likewise, he maintained that Pumarol’s mental health condition has not been a subject of controversy during the judicial process.
“Everyone here is clear that he has a mental condition. There is a robust medical record and that will be part of our defense during the trial on the merits,” he indicated.
The Second Chamber of the Criminal Court of Appeals of the National District revoked the no-grounds order that had favored Jean André Pumarol Fernández and ordered the opening of a trial, accepting the appeals filed by the Public Prosecutor’s Office and the victims. The defense announced that it will appeal the decision through the corresponding legal channels.
