Santo Domingo. The Second Chamber of the Court of Appeals of the National District will issue its decision this Thursday regarding the appeal filed by the Public Prosecutor’s Office to revoke the dismissal order issued in favor of Jean Andrés Pumarol Fernández, who is being prosecuted for the stabbing attack that occurred at the Naco Dorado IV residential complex.
With this appeal, the Public Prosecutor’s Office seeks to have the defendant sent to a full trial to answer for the events recorded during the incident, in which a woman lost her life and five other people were injured.
The controversy arises after the Seventh Instruction Court of the National District determined that Pumarol Fernández was acting under a psychotic episode when the events occurred, concluding that he was not criminally responsible and issuing a dismissal of the case.

However, the Prosecutor’s Office maintains that the evidence collected during the investigation justifies the case being heard in a trial, where the evidence can be debated and the criminal responsibility of the accused for the charge of voluntary manslaughter and other crimes related to the attack can be determined.

The decision adopted by the Court of Appeal will define whether the criterion of non-imputability accepted in the first instance is maintained or if the criminal process continues with the holding of a trial on the merits against Pumarol Fernández.
