Judge sends Alcántara communicators to trial for violation of private property by recording without authorization

SANTO DOMINGO. – The Sixth Instruction Court of the National District decided to send Francisco Alcántara Sánchez and José Alcántara Sánchez to trial on the merits, after considering the evidence presented by the Public Prosecutor’s Office sufficient for the crime of violation of private property, typified in articles 1 and 2 of Law 5869 of 1962. The accused entered a dwelling without the owners’ consent and recorded an audiovisual for the purpose of public denunciation, without legal authorization.

The judge in charge admitted the complaint filed by the owners of the property, Tomás Santana Carela and Juana Beras de Santana, who constituted themselves as victims, complainants, and civil plaintiffs, legally represented by Licda. Anny Elizabeth Guzmán Jiménez. In that order, Licda. Guzmán stated: “The exercise of communication is not a license or authorization to commit vandalism or crimes such as violating property, defaming or slandering, and it is in this sense that pseudo-communicators, disregarding the rules and legal precepts, became criminals of communication.”
