Dominican shot by ICE sparks standoff between Trump and New York authorities

The case of a Dominican man shot by U.S. Immigration and Customs Enforcement (ICE) agents during an immigration operation in Marble Hill has sparked differences between U.S. President Donald Trump and New York authorities, who are demanding explanations regarding the use of firearms in an intervention where a five-year-old child was present.
The Dominican citizen, identified as 28-year-old Óscar Belgal, was shot in the neck on Thursday, October 8, while inside a car accompanied by his son. The minor was unharmed, according to the information released about the incident.
The actions of immigration agents have sparked protests and calls for an independent investigation to clarify the circumstances under which the shooting occurred.
While local authorities question the procedure, Trump expressed his support for the federal agents and defended the detention of the immigrant, to whom he attributed a criminal record and alleged ties to criminal organizations.
Trump defends immigration operation
During a political event held in Syracuse in support of Republican gubernatorial candidate Bruce Blakeman, the U.S. president referred to the operation and defended the actions of the ICE agents.
Trump asserted that Belgal represents a threat to public safety and maintained that federal authorities acted against a person who, according to his statements, was wanted for his alleged involvement in a gang-related homicide.
These statements constitute accusations by the president and do not represent a judicial sentence, nor do they in themselves establish the criminal liability of the Dominican citizen.
During his speech, the ruler also questioned New York’s political leaders for their criticism of the immigration operations carried out by the federal government.

Likewise, he reiterated his stance on applying measures against so-called sanctuary cities, jurisdictions that establish restrictions on certain forms of cooperation between their local institutions and federal authorities in charge of enforcing immigration laws.
The presidential position contrasts with the demands of New York officials, who consider it necessary to clarify the procedures used during the intervention.
ICE justifies use of force
The Department of Homeland Security (DHS) maintains that Óscar Belgal attempted to use his vehicle against the agents participating in the operation to arrest him.
According to the federal version, the driver’s alleged maneuver led the officers to use their firearms during the procedure.
Immigration authorities also attribute to the detainee links to the organization known as Los Trinitarios and state that he has a criminal record.
However, these allegations correspond to the version of the federal institutions and must be distinguished from the conclusions that the courts may establish.
The case of the Dominican man shot by ICE agents has raised questions about the conditions under which the arrest was carried out, especially because the citizen was accompanied by his son.
Another aspect that has raised questions is the attire of the participating agents, who, according to available reports, were wearing civilian clothes and vests similar to those used by construction workers.

Videos do not clarify shooting
Images captured by security cameras and released after the incident show part of the intervention carried out in Marble Hill.
However, the known records do not allow for a complete reconstruction of the sequence of events that ended with Belgal being shot in the neck.
Among the aspects pending clarification are the driver’s actions, the instructions given by the officers, and the circumstances under which the firearms were used.
It is also sought to determine if there were alternatives to carry out the arrest without resorting to gunfire, particularly due to the presence of a minor inside the vehicle.
The five-year-old boy was unharmed, although his presence during the operation constitutes one of the central elements of the investigation requests.
Judge suspends deportation
Amidst the differences between federal and local authorities, the case of the Dominican man who was shot has also reached the U.S. justice system.
Federal Judge Paul Oetken ordered a temporary stay on any deportation attempts against Óscar Belgal while he reviews an emergency petition filed by his lawyers.
The judicial order establishes that the Dominican citizen must remain in custody in New York or New Jersey during the review period.
The measure provisionally prevents immigration authorities from executing their expulsion from the United States while the appeal filed with the court is being examined.
However, it does not constitute a final decision regarding your immigration status or the accusations made against you.
The judicial process is advancing in parallel with the questions regarding the operation and the requests to determine whether the force used by the agents adhered to the corresponding procedures.
Dominican community demands answers
The incident has had repercussions among residents of Marble Hill, a New York neighborhood with a significant presence of people of Dominican origin.
The protests following the shooting and the calls for an independent investigation reflect the concern of community sectors regarding the actions of immigration agents.
The demands are focused on knowing how the intervention was carried out, what the circumstances were that motivated the shots, and what measures were taken to protect the child who was accompanying the detainee.
Local officials have also requested transparency in the handling of information and explanations regarding the criteria used to resort to firearms during the arrest.
The case occurs amidst differences between the Trump administration and New York leaders regarding the implementation of immigration policies and the scope of federal authorities’ powers.
Investigation of the shot Dominican
Óscar Belgal’s situation remains linked to two main issues: the immigration and judicial proceedings he is facing and the clarification of the circumstances in which he was shot.
On one hand, federal authorities maintain their version that the detainee posed a danger to the agents during the intervention.
