“Senators reject postponement of the Penal Code and support its entry into force”

Santo Domingo.- Ruling party senators expressed their rejection of initiatives seeking to postpone the entry into force of the new Penal Code, considering that the legislative piece has been widely debated for years and that the country must move forward with its implementation.

In that sense, deputy Rogelio Genao stated that it is not possible to continue postponing the application of the penal code, as it is a process that, as he recalled, has been discussed for decades in the National Congress.

“That is not possible, it was established after it was voted on, after 30 years of congressional discussion. I arrived at the Chamber of Deputies in 1994 and that is where the projects began,” he/she expressed.

Genao added that the legislation included a period prior to its entry into force and defended the possibility of making adjustments subsequently.

“A one-year vacatio legis was established for it. After it enters into force, everyone will have the possibility to submit amendments,” he maintained.

Along the same lines, Deputy Pedro Catrain stated that, although the regulation could be modified later, the country should not continue to postpone its enactment.

“An article could be modified later, but I believe that enacting the Penal Code can no longer wait,” he indicated.

Catrain added that the sectors currently demanding a new postponement had sufficient time to debate the legislative piece.

“Those sectors that are demanding that the Penal Code be stopped had the time; we are finishing this legislative term and there is no time to analyze that penal code which has been under discussion for more than 20 years,” he pointed out.

For his part, legislator Secundino Velázquez Pimentel considered that the regulation should continue its course without further delays.

“It must be allowed to take its course… Dominican society deserves that code that was approved, I believe it was a necessity,” he expressed.

Likewise, Deputy Moisés Ayala described any attempt to postpone its entry into force as inappropriate.

“It would be a mistake… to want to postpone it. The code is a necessary piece for Dominican justice,” he stated.

During today’s session, the senators rejected the initiative submitted by Senator Edward Espiritusanto to postpone the entry into force of the Penal Code for six months.
