Lindsay Clancy returned to court Tuesday for the first hearing since a mistrial was declared in the case involving the deaths of her three young children.

Her attorney, Kevin Reddington, asked the judge to dismiss the case, arguing that prosecutors failed to prove Clancy was responsible for the deaths. “This entire case is based on speculation,” Reddington said, arguing there was no evidence that Clancy admitted to killing her children.

Clancy pleaded not guilty to three murder charges in connection with the deaths of her 5-year-old daughter Cora, 3-year-old son Dawson and infant son Callan, who died at the family’s home in Duxbury, Massachusetts, on January 24, 2023.

During the five-week trial, the defense argued that Clancy was suffering from postpartum psychosis and had been overmedicated when she strangled her children and attempted to take her own life. Prosecutors argued that she was criminally responsible and understood the severity of her actions.

The jury deadlocked, leading the judge to declare a mistrial more than three weeks ago. Prosecutors have not yet announced whether they will seek a new trial.
