CONAPE clarifies situation of woman who reported eviction and assures she has received accompaniment since 2018

Santo Domingo, R.D. – The National Council for the Elderly (CONAPE) reported that it has offered comprehensive support since 2018 to Mrs. Fiordaliza Santana, 82 years old, who recently reported having been evicted from the property where she resided with her mother.

According to the institution, Mrs. Santana initially went to CONAPE due to family conflicts related to the ownership of the apartment, pointing to her sister, Marianela Santana, 76 years old, as part of the conflict. During the conciliation process, Marianela presented a copy of the title that accredited her as the owner of the disputed property.

Years later, Fiordaliza reported that she had been the subject of an eviction lawsuit by a third party who claimed to have purchased the property. This version was confirmed by her sister before legal representatives of CONAPE. Since then, the organization’s legal team has provided legal advice in criminal, civil, and real estate areas, representation before the State Attorney, and support before the Community Prosecutor of the Sánchez Highway, where several complaints related to the case were filed. On May 14, 2025, a legal analyst from CONAPE accompanied the chief prosecutor to an inspection of the apartment to verify the complaints. Subsequently, the case was referred to the Specialized Prosecutor’s Office against Abuse and Mistreatment of the Elderly, attached to the Human Rights Department of the Attorney General’s Office. During the proceedings, a visit was made to the home of Marianela Santana, who claimed to have been the legitimate owner of the property for years and to have sold it legally. Due to the lack of agreement between the parties, the prosecutor’s office ruled for the archiving of the file. From a social perspective, CONAPE indicated that Mrs. Santana has been included in its assistance programs, receiving:

• Food rations
• Medications and specialized medical care
• A solidarity pension, granted through Decree No. 859-21

Furthermore, the eviction process was stopped by Resolution No. 584-24 of the State Attorney, which declared its incompetence to hear the case. In the last quarter of 2024, Mrs. Fiordaliza was offered voluntary admission to a state-subsidized geriatric center, a proposal that was declined but remains available in accordance with established protocols. The CONAPE concluded by reaffirming its commitment to the protection and defense of the rights of older adults in vulnerable situations, ensuring dignified, timely and respectful care, in line with the principles of human dignity and free self-determination.
