Higüey, La Altagracia.— The Judicial Office of Permanent Attention Services of La Altagracia province imposed three months of preventive detention as a coercive measure against the doctor Yorkis Darío Espiritusanto Núñez, accused of allegedly falsifying stamps, signatures, and official documents belonging to several of his colleagues.
The physician is being investigated for events that, according to the formal indictment, allegedly occurred at the Nuestra Señora de La Altagracia Maternal and Child Hospital, located in the municipality of Higüey.

The precautionary measure was adopted by the court while the Public Prosecutor’s Office investigation proceeds, which seeks to establish the circumstances under which the questioned documents were allegedly prepared or used and to determine potential criminal liabilities.
Doctor accused of using other professionals’ documents
According to the indictment, Espiritusanto Núñez allegedly forged stamps, signatures, and official documents belonging to several doctors who provide services at the hospital center.

The authorities must now determine the extent of the alleged forgeries, as well as the purpose for which they may have been used and whether they could have caused any harm to the professionals whose names and identification elements may have been used.
The investigation must also establish whether the indicated documents were used within administrative, medical, or other types of procedures and if there were other people involved in the events.
What does preventive detention imply?
Pretrial detention is a coercive measure that seeks to ensure that the defendant remains at the disposal of the justice system while the process is underway. It does not, in itself, constitute a declaration of guilt.

In this case, the court established a period of three months during which the Public Prosecutor’s Office may continue to collect evidence and carry out the corresponding proceedings.
Among the elements that may be part of an investigation of this nature are allegedly forged documents, administrative records, statements from the affected professionals, and other elements that allow for determining how the documents were prepared and used.
The defendant’s defense will, in the meantime, have the mechanisms established by Dominican legislation to appeal the decision or request a review of the measure, as the judicial process progresses.

The judicial decision represents, for now, a precautionary measure within a process that must still advance through the various stages established by the Dominican justice system before the criminal liability of the accused is determined.
