Santo Domingo.- The Second Criminal Chamber of the Court of Appeals of the National District is hearing this Monday the appeals filed against the decision that granted a dismissal of the case to Jean Andrés Pumarol Fernández, accused of carrying out a violent attack in the Naco district that left one person dead and several injured.
n” “nPumarol arrived this Monday morning at the Ciudad Nueva Palace of Justice wearing a long-sleeved shirt and accompanied by his lawyers, while dozens of people followed the development of the hearing closely, scheduled for 9:00 in the morning.

n” “nThe court, presided over by Judge Isis Muñiz, must evaluate the appeals filed by the Public Prosecutor’s Office and the plaintiffs against the decision issued on March 17 by the judge of the Seventh Instruction Court of the National District, Deiby Timoteo Peguero, who issued a no-case ruling in favor of the defendant.
The Court will be responsible for determining whether to ratify the investigating judge’s decision or, conversely, to accept the appeals and order the opening of a trial on the merits for the acts attributed to Pumarol.
Magistrate Peguero issued a dismissal order, considering that Jean Andrés Pumarol Fernández was not in a mental state fit to face a full trial, a decision that was appealed by the Public Prosecutor’s Office and the relatives of the case’s fatal victim, 70-year-old Ivonne Handal Abugabir.
