Santo Domingo.- The Second Criminal Chamber of the Court of Appeals of the National District reserved its ruling this Monday on the appeal filed against the dismissal order issued in favor of Jean Andrés Pumarol Fernández, who is accused of an incident that occurred in the Naco district that left one person dead and several injured. The full decision will be announced on July 23rd.

The hearing was held behind closed doors after Pumarol’s defense requested the removal of the media, arguing that sensitive aspects related to human dignity and the right to health would be addressed during the consideration of the appeal.

At the end of the hearing, the victims’ lawyer, Miguel Valerio, reiterated his confidence that the Court will revoke the dismissal order and send the case to trial.

“We believe the first-instance decision will be overturned. It will have to be determined whether it goes through a procedure for an unaccountable person or through an ordinary procedure, but it must go to a trial on the merits,” he expressed.

The Court of Appeal must decide whether to ratify the no-case ruling issued by the court of first instance or to order that the case continue its course before the corresponding jurisdiction.
