Santiago.- The defense for the former president of the Board of Directors for the Fight Against Cancer, Héctor Antonio Lora Cruceta, launched a strong attack this Thursday against the Public Prosecutor’s Office, asserting that Operation Onco-14 is a judicial persecution aimed at removing a group of executives from the Regional Oncology Institute through a case file they described as “abusive, arbitrary, and selective”.
n” “nAt the conclusion of the coercion measure hearing, postponed until next Monday the 29th, lawyers Juan Francisco Rodríguez Consoró and Luis Guillermo Gómez stated that the court must decide the case based on documentary evidence and not on the narrative presented by the prosecuting body.
n” “n“Society must read the file and examine the evidence, not be swayed by a single version”, expressed Rodríguez Consoró, who maintained that the Patronato de Lucha Contra el Cáncer is a private non-profit institution, governed by Law 122-05, and that it was subject to an intervention that, as he claimed, violated its statutes and its institutional autonomy.
n” “nThe defense asserted that there are civil lawsuits seeking to annul the assembly through which the previous board was replaced and denounced that, while those processes remain pending, the Public Prosecutor’s Office promoted Operation Onco-14 to, allegedly, force the definitive departure of the former board members of the foundation.

n” “nThe lawyers also described the accusation as “selective,” arguing that the case file itself attributes financial decisions to the entire previous board of directors, but only Lora Cruceta, his ex-wife Dilcia Isabel Vargas Sánchez, and other defendants were prosecuted.
“If all decisions were collegiate and everyone signed off on them, why are only some sitting in the dock?” questioned Rodríguez Consoró, who also pointed out that former members of the board, now linked to the current administration of the foundation, were not included in the process.
n” “nLuis Guillermo Gómez stated that the Board of Trustees does not receive public funds and reiterated that the actions under investigation were approved by a council composed of nine members, which is why he considered it unjustified for the Public Prosecutor’s Office to focus criminal prosecution on a specific group.

The defense concluded by accusing the prosecuting body of violating the fundamental rights of the accused and warned that, if this precedent were to prosper, any foundation or non-profit organization could be subject to similar interventions due to internal decisions by its governing bodies.
