Santo Domingo.- The Superior Electoral Court (TSE) accepted the motion of inadmissibility raised by the respondent and, consequently, declared inadmissible the amparo action that was declined to that high court by the Second Chamber of the Civil and Commercial Court of the Court of First Instance of the National District, through Civil Judgment number 035-2026-SSEN-00653, dated June 2, 2026.
With the unanimous vote of magistrates Ygnacio Pascual Camacho Hidalgo, presiding judge, and titular judges Pedro Pablo Yermenos Forastieri, Fernando Fernández Cruz, Rafaelina Peralta Arias, and Lenis Rosángela García Guzmán, the Court based its decision on the consideration that the amparo action is notoriously inadmissible, in accordance with the provisions of Article 70, numeral 3, of Law No. 137-11, Organic Law of the Constitutional Court and Constitutional Procedures, as well as Article 132, numeral 3, of the Regulation of Contentious Electoral Procedures, since the request made by the petitioners raises abstract claims typical of a direct action of unconstitutionality.
The amparo action was filed by citizens José Antonio Cabral Salcedo and Isaías Ramos Guzmán against Luis Rodolfo Abinader Corona, in his capacity as President of the Dominican Republic and head of the Executive Branch.
