Santo Domingo.– Lawyer Zelandia Díaz, legal representative of the minor Dayron Almonte Socias, denounced this Tuesday that the Ministry of Public Health maintains its refusal to provide a high-cost medication required for the treatment of Spinal Muscular Atrophy, a condition that affects the child and which, she stated, seriously compromises his state of health.
During statements made in a video posted on the TikTok platform, Díaz expressed his disagreement with the position taken by the Ministry, pointing out that the institution requested the court to reject the amparo action filed by the family and refer the claim to the contentious-administrative jurisdiction.
As explained, Dayron is admitted to a pediatric intensive care unit and had recently required a blood transfusion due to complications associated with his medical condition.

The representative maintained that the writ of amparo was filed due to the urgency of the case and the need to guarantee fundamental rights related to the child’s life and health. In that sense, she questioned that the State has not provided the requested medication despite it being, as she stated, an essential treatment for the child’s survival.
Likewise, he compared the cost of the treatment with budget items allocated by the Ministry for advertising expenses, arguing that public resources should prioritize the care of patients with highly complex diseases.

During his video, he also criticized what he described as a contradiction between official pronouncements regarding universal access to healthcare and the refusal to provide the medication required by the minor.
The legal representative reported that the parties are awaiting the court’s decision and the reading of the corresponding sentence. She expressed her confidence that the ruling will be favorable and will allow for guaranteeing not only Dayron‘s treatment, but also access to medication for other Dominican patients suffering from the same disease.
