San Pedro de Macorís.– The Civil Chamber of the Court of First Instance of San Pedro de Macorís ordered the provisional suspension of the adjudication judgment used by Suheil Elías Atallah Lajam as the basis for the execution of evictions at Metro Country Club.

The judicial decision temporarily halts the evictions that had been carried out over the last few days against owners occupying their properties under valid property titles.

According to the background presented in the proceedings, the conflict originates from a situation of registration duplicity previously confirmed by the Regional Directorate of Cadastral Surveys, a circumstance that has generated controversies regarding the ownership of certain properties within the residential complex.

The request for the urgent provisional measure (petit référé) was filed by Yurosky Mazara, lawyer for Metro Country Club, who argued the existence of an imminent danger arising from evictions carried out without due procedural guarantees. Likewise, he explained to the court the gravity of the situation and the potential social consequences that could arise from the continuation of such actions.

Mazara maintained that the authorizations for the use of public force were granted without the affected persons being previously summoned or heard, to the detriment of owners who hold valid titles and have maintained peaceful possession of their properties for more than three decades.

After evaluating the arguments presented, the court granted the request and ordered the provisional suspension of the challenged measures until the merits of the summary proceeding are heard and decided.

The next hearing was set for Tuesday, June 2, a date on which the proceedings will continue and the substantive aspects of the controversy will be debated.
